Okay back in Decemeber on the 19th specficly me and my old room mate moved out of our previous apartment. We paid the re letting fee that we were told was all we had to pay. We put in the 30 days notice. Everything we were told we had to do.
Then the apartment complex was bought out at the end of december by a new company that I might add has a bicth for a manager. They apparently while haveing the notice on file has nothing else. So they kept us as living there. They sent notice to the aparemnt we were obviously not living at. The notice was addressed to my dad who while did pay the deposite did not even sign the lease. The notice never @#%$ got to us due to there stupdity. So now they are charging us $3733.06 through a creditor because they were to @#%$ lazy to contact us. My new home address which is my parents address is on the contact information. So is my partents buisness address.
I don't have the money to pay this. I don't have a job still but I am looking and should have an interview this week. I have plans to move out of this state but it looks like they are pretty much dead now. God mother @#%$ damnit this @#%$ pisses me off. We had a verbal contract telling us what to do. Pay the re letting fee is all they told us they were going to charge us. Now we are getting screwed for doing what we were told to do. This sucks.

i don't know much about USA laws , but in here if you can prove he didn't send it to your address that you listed in the contract they take responsiblity not you

thats why companies have to file a " no one to collect " ( i don't know how to translate that better into english ) to prove that they sent it to you and you didn't take it

We are probably going to do something on that. Plus bring up that it is there nelagence that kept the aparetment open due to the fact that we had notice of moving out. We turned in the keys and everything.

Ohh and I talked to my bank and am looking at to print outs of checks showing that I payed rent and the re letting fee. My room mate also got copies of the checks from his bank.

If you get hassled even after showing them that you paid the re-letting fee, don't get into a big shouting match or anything; just contact the local police department (the PD in charge of your old place's area, not the PD that's in charge of where you live now) and ask them if they can help you.

Most likely an officer will look at what you have, make a couple phone calls, and it'll be sorted out properly and without further drama.

As long as you have a paper trial of your payments and a copy of your lease (always demand a copy of the lease/contract ALWAYS) you should be fine, other than having to deal with some correspondence letters. I'd make sure and document (copy your check for the re letting, the letter that you had sent them, and then inform them in a letter that if they don't act to correct the issue that you'll be seeking legal action. Some Times it helps to drop a card of a layer you know in there, just to add emphasis that your ready to go to war at the drop of a hat. Should make them jump and pay attention.

The one thing you don't want to do is have any of this show up on your Credit Report. I would be utterly furious over the fact that it may blemish my credit report and not so much that they want money (because they aren't getting a dime the dumb asses).

lol - I don't recall the last time our Chief has ever gone out on a routine call, but yes, usually all it takes is a "Hello, this is Officer...." to know that the stakes have been raised.

I worked in a video store back in college. Some people just never return movies and after 8 million messages and letters, you finally call the police. The movie is usually returned inside of 12 hours from that point.

Acts of Gord cracks me up because it is oh so true in the world of retail.

a re-letting fee is compensation to the landlord for you breaking the lease early; it's money given to the landlord so he can find a new tenant. If he accepts the re-letting fee, he can't charge you for future rent (which is what's happening in this case). The new landlord is still obligated to honour the old landloard's acceptance of the re-letting fee.

Well we went back after taking my room mates check print outs in. We took mine in as well and got a copy of our lease. They gave us a print out of what all the charges are for. Most of them are wrong. THey are overcharging us for the rent on there. Actually about $50 more than they should be even if this was legit. My room mate talked to the company that handles the leases and from what they said none of this should have happend. They are also trying to charge us for the days that it was vacant which apparently they are getting someone in on the 14 which means that they are overcharging us for that.
The notice they sent out was sent to the wrong person at the wrong address for anyone involved. The collections has also only gone out on my room mate. Nothing has ever come to me about it.

I talked to my mom and she is going to talk to my dad so we will see where it goes from there.
